1. Acceptance of Terms
These Terms of Use (“Terms”) govern your access to and use of Plotzy, Inc.’s websites, software applications, and online services, including the Plotzy Digital Platform, Enterprise Portals, and related tools or APIs (collectively, the “Platform”). By accessing or using the Platform or Site, you agree to be bound by these Terms and our Privacy Policy. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization.
2. Scope and Eligibility
These Terms apply to enterprise subscribers and authorized users, self-service users, and visitors who browse our public site. You must be at least 18 years old, or the legal age of majority in your jurisdiction, to use the Platform.
3. Account Registration
You may be required to register for an account. You agree to provide accurate information, maintain credential confidentiality, notify us of unauthorized access, and accept responsibility for all activity under your account.
4. Authorized Use of the Platform
You may not reverse engineer, copy, modify, resell, or interfere with the Platform, bypass security controls, transmit malicious code, misrepresent identity, or otherwise misuse the Platform. Plotzy may investigate violations and take enforcement action, including account termination.
5. Enterprise Subscribers
If you use the Platform under a separate subscription agreement, that agreement also governs your use. In case of conflict, the subscription agreement controls.
6. Intellectual Property Rights
All rights in the Platform and Site are owned by Plotzy or its licensors. No rights are granted except as expressly provided. You retain ownership of your content, and grant Plotzy a limited license to host, store, and process it solely to provide and improve the Platform.
7. Confidentiality and Data Protection
Data submitted to the Platform is handled under the Privacy Policy and applicable law. Plotzy does not sell personal information and processes subscriber data as described in applicable agreements.
8. Fees and Payments
Paid users agree to pay applicable fees shown at checkout or in subscription agreements. Fees are generally non-refundable unless required by law or agreed in writing. Plotzy may suspend access for non-payment after reasonable notice.
9. Third-Party Services
The Platform may link to or integrate with third-party services. Plotzy is not responsible for third-party availability, accuracy, or privacy practices.
10. Termination
Plotzy may suspend or terminate access for violations of these Terms, harmful conduct, or non-payment. Upon termination, your right to access the Platform ceases immediately.
11. Disclaimers
The Platform is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.
12. Limitation of Liability
To the maximum extent permitted by law, Plotzy is not liable for indirect, incidental, consequential, punitive, or exemplary damages. Total liability is limited to amounts paid in the 12 months preceding the claim.
13. Indemnification
You agree to defend and indemnify Plotzy from claims, damages, and expenses arising from your use of the Platform, your content, or your violation of these Terms or applicable law.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on the Site or communicated by email. Continued use after updates constitutes acceptance.
15. Governing Law
These Terms are governed by Delaware law. Disputes must be brought in state or federal courts located in Delaware.
16. Zoning Data and AI-Generated Content
Zoning and land use information and AI-generated outputs are for informational purposes only, are not professional advice, and may contain errors. You must independently verify all zoning and code information with the applicable municipality or qualified professionals before making decisions.
17. No Legal or Professional Advice
Information provided through the Platform, including zoning, ownership, and property data, is general informational content and not legal, financial, or professional advice.
18. Export Compliance
You agree to comply with all applicable export control and trade laws and not use the Platform in prohibited jurisdictions.
